1. Three-fourths guarantee: Employment will be offered for a total number of work hours equal to at least three fourths of the workdays of the total period of employment.
- Workers will be offered employment for a total number of work hours equal to at least three fourths of the work days of the total period that begins with the first workday after the arrival of the worker at the place of employment or the advertised contractual first date of need, whichever is later, and ends on the expiration date specified in the work contract or in its extensions, if any.
Therefore, since the work contract is for a 156-week period (3 years: 52 weeks / year), during which a normal workweek is specified as 7 days a week, 5 hours per day, the worker would have to be guaranteed employment for at least 4,095 hours (156 weeks × 35 hours/week = 5460 hours × 75 percent = 4095). If a Federal holiday occurred during the 156-week period, the 5 hours would be deducted from the total hours for the work contract, before the guarantee is calculated. Continuing with the above example, the worker would have to be guaranteed employment for 4,085.75 hours (156 weeks × 35 hours/week = 5,460 hours−15 hours (Federal holiday) = 5,445 hours × 75 percent = 4,083.75 hours).
2. Transportation and Subsistence: Transportation (including meals and, to the extent necessary, lodging) to the place of employment will be provided, or its cost to workers reimbursed, if the worker completes half the employment period. Return transportation will be provided if the worker completes the employment period or is dismissed early by the employer.
- If the worker completes 50 percent of the work contract period, the employer will provide, reimburse, or advance payment for the worker's transportation and subsistence from the place of recruitment to the place of work. Upon completion of the work contract or where the worker is dismissed earlier, the employer will provide or pay for the worker's reasonable costs or return transportation and subsistence back home or to the place the worker originally departed to work, except where the worker will not return due to subsequent employment with another employer or where the employer has appropriately reported a worker's voluntary abandonment of employment. The amount of transportation payment of reimbursement will be equal to the most economical and reasonable common carrier for the distances involved.
